PURCHASING DIGITAL DOWNLOADS THROUGH THE SHOPPING CART
Licensed rights can be purchased through the shopping cart for most of my photographs, for either personal or commercial use. Please note that downloads do not have the watermarks shown here on displayed images. Downloads are created from original files saved in the highest .JPG resolution available in Photoshop (eg the least compression, option 12.) Original .JPG file sizes range from three to seven megabytes.
To purchase a download, locate and display the photograph you want, click "Buy This Photo" and then click "On to Cart." In the Product box, select "Digital Downloads." If the price is right for the option you need and if the license agreement is acceptable, click "Next" to continue with the purchase.
Note: Prices listed below are nominal, and may be increased for individual photographs as their popularity increases. Increases in price subsequent to purchase have no effect on any license previously granted.
PERSONAL USE:
File downloads licensed for personal use are approximately one megapixel, suitable for use as a screensaver, for example. The price is $20 for most photographs.
Please read the license agreement carefully. "Personal use" means exactly that. The file downloaded can be used for non-commercial purposes ONLY by the person purchasing the download, and cannot be resold, given or loaned to anyone else for any purpose.

Photographer grants buyer a non-exclusive perpetual personal-use license to download and copy the accompanying image, subject to the following restrictions:
(1) This license is for personal use only. Personal use means non-commercial use of the image(s) for display on personal websites and computers, or making prints for personal use. The image(s) may not be used in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration. The image(s) may not be used in advertising. The image(s) may not be resold, relicensed, or sub-licensed.
(2) Title and ownership, and all rights now and in the future, of and for the image(s) remain exclusively with the photographer.
(3) There are no warranties, express or implied. The image(s) are provided 'as is.'
(4) Neither photographer nor SmugMug will be liable for any third party claims or incidental, consequential or other damages arising out of this license or buyer's use of the image(s).

COMMERCIAL USE
File downloads licensed for commercial use are available in three resolutions:
--- Low (approximately one megapixel) $30.00 for most photographs.
--- Medium (approximately four megapixels) $75.00 for most photographs.
--- Original (size is shown under each photo) $125 for most photographs.
File sizes and types not shown may be available directly from me to meet your needs, from small low-resolution .JPG files to 16-bit loss-less LZW compressed .TIF files. I will be happy to discuss licensing arrangements specific to your needs, including exclusive use for a specified time period. What you CAN do: Photographer grants you a perpetual, non-exclusive, non-transferable, worldwide license to use this image for permitted commercial purposes, defined as:
(1) advertising, promotion, brochures, packaging
(2) use as part of a commercial website for promotional purposes (maximum 800x600pixels)
(3) prints, posters, flyers, tearsheets for promotional purposes (not for resale)
(4) prints, posters, or other commercial display of image
(5) magazines, books, newspapers, other printed publications
(6) video, broadcast, theatrical
What you may NOT do:
(1) Buyer may not resell, relicense, redistribute without express written permission from photographer.
(2) Use as a derivative work, and reselling or redistributing such derivative work is prohibited.
(3) Images may not be used in a pornographic, obscene, illegal, immoral, libelous or defamatory manner.
(4) Images may not be incorporated into trademarks, logos, or service marks.
(5) Image may not be made available for download.
Photographer retains all rights, license, copyright, title and ownership of the image(s).
There is no warranty, express or implied, with the purchase of this digital image file. Neither photographer nor SmugMug will be liable for any claims, or incidental, consequential or other damages arising out of this license or buyer's use of the image(s).
